4.1 We may disclose all or some of your personal data mentioned in Section 3 to our subsidiary company insofar as reasonably necessary for the purposes, and on the legal bases, set out in this policy and the applicable data protection laws and regulations. 4.2 We may disclose your personal data to our insurers and/or professional advisers insofar as reasonably necessary for the purposes of obtaining or maintaining insurance coverage, managing risks, obtaining professional advice, or the establishment, exercise or defence of legal claims, whether in court proceedings or in an administrative or out-of-court procedure.

4.3 Financial transactions relating to EveryEng and services are currently handled by our payment services providers, RazorPay. We will share transaction data with our payment services providers only to the extent necessary for the purposes of processing your payments, refunding such payments and dealing with complaints and queries relating to such payments and refunds. 4.4 We may disclose your enquiry data post your consent only to one or more of those selected third party suppliers of goods and services identified on EveryEng for the purpose of enabling them to contact you so that they can offer, market and sell relevant goods and/or services to you. Each such third party will act as a data controller Fiduciary in relation to the enquiry data that we supply to it; and upon contacting you, each such third party will supply to you a copy of its own privacy policy, which will govern that third party's use of your personal data.

4.5 In addition to the specific disclosures of personal data set out in this Section 4 so far, we may disclose any of your personal data mentioned in section 3, where such disclosure is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person. We may also disclose your personal data where such disclosure is necessary for the establishment, exercise or defence of legal claims, whether in court proceedings or in an administrative or out-of-court procedure.

5.1 We and our other group companies have offices and facilities in India. Transfers to our companies within India shall be governed by your consent and/or legal basis namely the proper administration of EveryEng and business and the performance of a contract between you and us and protected either by appropriate safeguards - i.e., the use of standard data protection contractual clauses as modelled under the latest Standard Contractual Clauses of European commission OR any other applicable data privacy mechanism OR by the Adequacy Decision between that country and India OR whichever is applicable.

5.2 The hosting facilities for EveryEng are situated in India and in North Europe. The European Commission and the UK has made an "adequacy decision" with respect to the data protection laws of each of these countries. The details of the same are available on the ico.org.uk website  

5.3 Supplier or subcontractor [is] OR [are] situated globally. Transfers to our companies within India and the third countries outside EEA shall be governed by your consent and/or legal basis namely the proper administration of EveryEng and business and the performance of a contract between you and us and protected either by appropriate safeguards, i.e., the use of standard data protection contractual clauses as already adopted / approved by the European Commission or by the Adequacy Decision between that country and Europe, or whichever is applicable.

5.4 You acknowledge that personal data that you submit for publication through EveryEng or services may be available, via the internet, around the world, and can be misused by the visitor of the website, despite having the adequate security safeguards proportionate to the risks assessed.

6.1 With reference to section 3, the personal data that we process for the purpose or purposes mentioned shall not be kept for longer than is necessary to fulfil the mentioned purpose or purposes.

6.2 It is not possible for us to provide you in advance the retention period for the data processed in the section 3, but we will determine the period of retention based on the following criteria:

(a) general activity of this data date in a rolling 12 months period.

6.3 Notwithstanding the other provisions of this Section 6, we may retain your personal data where such retention is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.
